PRIVACY POLICY
Pentester, LLC (“Pentester", "we", "us") understands the importance of protecting the privacy of visitors to the www.pentester.com website ("Visitors") and Visitors who have registered accounts to transact business with us ("Authorized Users") (collectively, "you", "your"). This Privacy Policy provides information on how personal information is obtained through your use of mobile applications for accessing Pentester services, www.Pentester.com, or related sites, (together, the “System”), and is processed and used on this by us and our service providers. This Privacy Policy does not address information obtained through penetration testing. For such information see our Terms of Use. Pentester uses your personal information only in ways that are compatible with this Privacy Policy. In addition to reviewing this Privacy Policy, please read our Terms of Use. Your use of the System constitutes agreement to be bound by the Terms of Use and this Privacy Policy. If you do not agree to the Terms of Use and this Privacy Policy, you should not use this System. This Privacy Policy does not cover information collected on sites linked to or from the System.
Information Collected. Pentester collects personal information from you when you provide personal data through our System and through automated processes. Some of the information below may be collected by one or more service providers to Pentester on its behalf. The following categories of information may be collected, some or all of which may be considered personal information: Identifiers and other personal information such as your name, birthday, billing address, shipping address, email address, telephone number, account number, password, user ID, mobile device IDs, and Internet Protocol address. (b) Internet or other network activity, such as information concerning your interaction with the System, content hosted on the System and users you follow or are followed by, and the devices, mobile apps and browsers you use to interact with the System or a service provider's web app or service. (c) Inferences drawn from other personal information, such as a profile reflecting your preferences in activities, products and delivery methods, and any of your preferences that you share with us. (d) Information voluntarily entered by you into the System, such as Content you may enter for publication to others. (e) Geolocation data from your mobile device. (f) Photographs, which may be used to derive biometric information about you.
The System generally collects personally identifying information with your specific knowledge and consent. For instance, when you complete a survey, subscribe to our publication(s), or register an account for any portion of our services, you are asked to provide information such as your email address, name or phone number. Depending on your use of the System, some of the personal information we collect is required and some is provided by you voluntarily. You may choose not to provide certain requested information, and you may continue to use the System without providing such information. However, if you do not provide the required information for a particular activity, you may not be permitted to engage in that activity.
Pentester may collect and store additional usage information such as where, what and when you are searching. Information about your use of Pentester products and services may be aggregated or otherwise de-identified for business and marketing uses by us or by third parties. Pentester reserves the right to use aggregated or otherwise de-identified information gathered by it for any and all purposes.
Service Provider Systems and Access. Our systems are primarily hosted by service providers that provide us with services, such as web hosting services, technical maintenance and search software. Our service providers may have access to your personal information collected for our use, but only for the purpose of and to the extent necessary to provide those services.
Use of Information. Your personal information is used for purposes of providing you with information, goods and/or services requested by you, providing for a follow up with you in connection with goods or services you request and as a part of our mailings and solicitations to prospective customers. In particular, Pentester uses the personal information we collect for various commercial and business purposes, including to: (a) create your Account; (b) send you email / mobile text communications and/or alerts, and/or newsletters or other information you have requested; (c) respond to questions or other requests; (d) make available, administer, and improve the System and the content, features and services provided by the System, including diagnosing performance issues with our System; (e) update, supplement and maintain the accuracy and completeness of our information; (f) contact you with respect to your use of the System or changes to this Privacy Policy or other Pentester policies; (g) conduct market research; (h) use for our internal business purposes; (i) send you other notices in order to comply with applicable laws and regulations; (j) to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by us is among the assets transferred; (k) manage your contact preferences and requests, including requests concerning how we use and share your data; (l) to cooperate with legal investigations or other legal proceedings; and (m) for other purposes disclosed at the time you provide your personal information.
Disclosure of Personal Information. Except as set forth in this Privacy Policy, Pentester does not share, rent or sell personal information about you with other people or companies. We reserve the right to use in any manner and also to disclose any non-personal information that we collect including, but not limited to, anonymous information including, but not limited to, cookie and traffic data. This Privacy Policy covers the use of cookies by us and does not cover the use of cookies by any advertisers. If you wish to opt-out of such advertising, third-party available third-party tools to opt-out include the Digital Advertising Alliance and the Network Advertising Initiative.
Information Automatically Collected. In addition to the categories of information identified above, we automatically receive and collect certain types of information whenever you visit our System. For example, like many Systems, we use “cookies” and web beacons to obtain certain types of information 13694167.3 when your web browser accesses our System. We use this information to monitor the usage and performance of our System, to enhance our customers’ search experiences and to determine aggregate information about our user base and usage patterns. We also use your IP address to help diagnose problems with our server, to administer our System, and to communicate with you using our on-line chat functionality and/or after you have sent us emails. If you send us emails, from time to time we may use information about your preferences and interests to send updates to you about Pentester, its services, listing, special offers, or information that may be of interest to you. If you do not want any cookies, your web browser likely includes an option that allows you to not accept them. However, if you set your browser to refuse cookies, some portions of the System may not function properly.
Do Not Track. Pentester does not track its System users over time and across third party Systems in order to provide targeted advertising. Pentester therefore does not respond to Do Not Track (DNT) signals. However, some third-party sites do keep track of your browsing activities when they serve you content, which enables them to tailor information that is presented to you. If you are visiting third party sites, you should become familiar with the site’s tracking policies. Pentester makes no representations and accepts no responsibility for the tracking activities of any third party.
Security. Except for Content and other information that you provide or enter into the System for sharing with others, including information accessed on your mobile device by System with your permission(s), Pentester will use reasonable precautions to keep the information disclosed to us secure and not to disclose such information to any third parties other than our service providers. However, we are not responsible for any breach of security or for any actions of any third parties that may receive the information. Access to your personal information is limited to people who need it to do their job. We cannot guarantee the protection of information against interception, misappropriation, misuse, or alteration or that your information may be disclosed or accessed by accidental circumstances or by the unauthorized acts of others. We have no control over the security of other sites on the Internet you might visit, interact with, or from which you buy products or services.
Linked Web Sites. Our System may include links to and/or links from other Systems operated and maintained by separate companies. We have no responsibility for linked or linking Systems and provide these links solely for the convenience and information of our visitors. Those Systems may have different privacy policies. If you click through to another System, you should check the privacy policy of that System, which will usually (but not always) be posted on the System. Pentester is not responsible for the privacy policies of other sites.
Children. This System is directed to adults and is not directed to children under the age of 18. Pentester complies with the Children's Online Privacy Protection Act and does not permit registration by and will not knowingly collect personally identifiable information from anyone under 18. This Privacy Policy will be posted on the System.
Changes to Information. We need your help in making sure your personal information is correct in our systems. Please notify us of changes to your name, address, title, phone number or email address. You may do this by logging into your account and making corrections or contacting us at the email below. You may also select the option not to receive future contacts from Pentester (for example, mailings, calls, etc.) by emailing us at the address below. In the event you elect not to receive any future contacts from Pentester, we will endeavor to remove your name from all of our contact lists. We shall have no liability under this Privacy Policy for our failure to accomplish this objective.
CALIFORNIA PRIVACY RIGHTS
If you are a California resident, California Civil Code Section 1798.83 permits you to request information with respect to the disclosure of your personal information by us to third parties for such third parties’ direct marketing purposes. Your Consent. By using our System, you consent to the collection, use and disclosure of information in accordance with the terms of this Privacy Policy. By using our System, you should also be aware that any personally identifiable information you submit can be read, collected, or used by other users of the System, and could be used to send you unsolicited messages. We are not responsible for the personally identifiable information you choose to submit through your use of the System.
We reserve the right to modify or amend this Privacy Policy at any time in our sole and absolute discretion. If we change our Privacy Policy, we will post any changes on this page and your continued use of the System constitutes your acceptance and agreement to any revisions to our Privacy Policy.
